Freedom Only Sustainable Under Apportionment Clause In Constitution
If you read my posts a little more closely you will find that I stated that The Constitution was established to protect us from Majority (Mob) rule and from Minority rule. The Constitution was also established to ensure that the Federal Government never received enough money to usurp our freedoms through growth and power of the Federal Government that would be only available to it by the completely unconstitutional legislation that would establish a central bank owned by a private company, such as we have now called THE FEDERAL RESERVE, where the U.S. Government could borrow as much Dollars as they want to effectively destroying the Gold Standard and making the TRUE VALUE of our currency virtually worthless, which results in massive inflation and skyrocketing costs for the necessities of life to the point that WE MAY NOT BE ABLE TO AFFORD TO LIVE. The other unconstitutional act, amongst several, that allowed the U.S. Government to grow beyond the limits of The Constitution, was the faux passage of the 16th Amendment, which was supposed to get around the “apportionment” taxation clause, meaning that all people are to be, PER THE LAW, taxed the exact same dollar amount whether you make $20,000 a year or $10 million a year. The Founding Fathers did this so that Government wouldn’t be able to have a sustained income tax, over the long run, at all and so that Government wouldn’t have the right or need to poke their dam* noses into our financial affairs or make us file reports, which in a FREE society is sickening and absolutely gross! The Founding Fathers knew that the ability to tax is the ability to destroy, control, manipulate, oppress and tyrannize. That is the reason for the “apportionment” clause in The Constitution. Big Constitutionally contempt Government is what ultimately caused our current financial crisis and imminent economic collapse that is resulting from all manner of contemptuous incremental illegal legislation, Congressional scofflaw activities and behaviors over decades.

The movie “America From Freedom to Fascism” explained this in great detail. Nothing in the constitution allows for the IRS to tax personal income. IRS typically says it is the 16th amendment that allows them to tax personal income, but multiple supreme court rulings have said the 16th amendment does not allow for any new types of tax, so personal income tax is still illegal. Apparently many people have stopped paying federal income tax and have been acquitted in the courts because the IRS can not site what laws require people to file income tax each year and to pay personal income tax. Multiple ex-IRS employees were interviewed who all confirmed they spent lots of time and research trying to find such a law only to discover there is none. While it is apparently illegal to file a false tax return, there is apparently no law requiring you to file a return in the first place. “The constitution allows for two kinds of taxes. They’re called direct and indirect. The federal government in the Constitution can tax almost anything, as long as it apportions the tax if it’s direct. The indirect tax is, for example, an excise tax. I can avoid the excise tax on gasoline. … The income tax which is being applied now doesn’t meet the criteria of either direct or indirect taxes. The IRS claims that in 1913, the 16th Amendment, the income tax amendment, allowed the government a third form of taxation. What was the Supreme Court’s ruling on that? … The provisions of the 16thment Amendment conferred no new powers of taxation. The case also said that the 16th Amendment did not impose any new taxes and did not change any of the taxing restrictions of the Constitution.” **************************************************************************************** The Federal Government is not supposed to have the money to create department after department, program after program, Social Security after Social Security, Medicare after Medicare, Universal Health Insurance after Universal Health Insurance, Government “Help” and “Assistance” after Government “Help” and “Assistance”. These things have been made financially impossible by The Constitution of the United States of America because these are the very things that DESTROY FREEDOM (from Government). That is the reason for the “apportionment” clause, why we didn’t have income taxes for almost ONE HUNDRED FIFTY YEARS, and why America became a ‘SUPERPOWER’ during that time period. Freedom (from Government), only truly sustainable under an apportionment clause like the one in our Constitution, is the GREATEST generator of INDIVIDUAL PERSONAL WEALTH ever conceived! Can you even imagine how much money you would have and how much nicer your life would be if there were no Income Taxes or Payroll “Withholding” taxes from all of your paychecks? The U.S. Government is supposed to be VERY SMALL according to numerous writings of the Founding Fathers. State Governments, on the other hand, are supposed to be large and duplicate many, but not all, of the services now provided by the U.S. Government, amongst each of them. In this way there would be competition between the States to entice people and to ensure that FREEDOM reigns. If a State charges too much tax or tries to usurp our FREEDOM (from Government) we would simply move to a State that has it RIGHT! That is how it is supposed to work. Now, take gasoline cost for example. If the Federal Government would obey the Constitution they wouldn’t have the ability to tell the States what to do or not do. So the States could allow FREEDOM (from Government) for our oil companies and, there by, they would be free to drill for the Billions, or by some accounts Trillions, of barrels of oil (and volumes of natural gas) available domestically. Each State would have the right to allow FREEDOM to let companies build refineries at low cost and as much pollution control and associated cost as would make the local State population happy. This would allow for cheap energy which would make the cost of products and food in that State cheap. We would all want to move to States like that because the wages / salaries would be high there because the economy due to the prosperity would be so good there. Energy is the life blood of FREEDOM (from Government). Getting back to the topic at hand; Our Constitution is so designed that we are to be INDIVIDUALLY FREE. No majority or minority is to be controlled by anyone else. That is the reason for NOT HAVING A DEMOCRACY. AMERICA does not have a comprehensive DEMOCRACY. We have a REPRESENTATIVE GOVERNMENT, to ensure that the majority does not rule and so that the minority doesn’t either. But through unconstitutional acts, the primary being The Federal Reserve Act of 1913 and the “perception” of the Sixteenth Amendment ratification or even the perception that it allows Income Taxation at all is and has destroyed our FREEDOM and is now costing us dearly in our personal finances in the fact that energy, food and prices on all things are getting too expensive to bare for the average person. That is why we have to FORCE Government by ANY MEANS NECESSARY to comport to the Constitution to the VERY WORD, meaning, intent and SPIRIT of the day of which it was drafted. To hell with the spin conveyed by those who seek oppression and tyranny upon us, whether they be the Socialist Liberal “Loyalists” that live amongst us or the despots in both houses of Congress, that state that the apportionment clause is “absurd”. I think they are absurd and I have a very sharp pitchfork to prove my point to all of them. And I know how to get to capital hill! When the time comes that they come to collect the additional taxes they will need to support Social Security and Medicare, that is somewhere between 70 – 90 Trillion Dollars in UNFUNDED LIABILITIES, over the infinite horizon, my pitchfork will be extremely well sharpened. And, I know they are coming soon. I know that with in just a very few years they are going to start to send notices to our employers to start taking more money out of our paychecks in “payroll” taxes to pay for the Banker Bailout bill/s, Social Security and Medicare. I will demand to my employer that he not take out any withholding tax because I need to feed my family, cloth my children and provide heat and light and be able to drive to work. If enough of us start demanding that our employers stop withholding, because our families are literally starving and/or freezing to death in the cold and darkness and the Government starts to threaten the people who need Social Security and Medicare to live, that they are going to start massively cutting back on Social Security and Medicare, what do you think those people are going to do and say to those of us who are not letting our employers “withhold” anymore? I am telling you folks, that we are headed for War. A combination Civil and Re-Revolutionary War, which will be a battle for “survival” for both sides and a battle for FREEDOM (from Government) over SOCIALISM. Are we going to accept the chains and bondage and massive apartment complexes with BIG BROTHER TV cameras to control and oppress us to the point that we only having the equal distribution of misery of the soup kitchens of the Socialist Welfare State or are we going to have FREEDOM with plenty of cheap energy and quality of life by way of FREEDOM (from Government)? I see hundreds of thousands of my fellow countrymen coming together to fight tyranny as FREE men. And FREE men you are. What will you do with that freedom? Will you Fight? ,As they and their children are herded by the masses into little one and two bedroom huge apartment complexes in major cities, to minimize our human “carbon footprint” and to avoid the necessity to travel, with what amounts to Government processed food, what and how much decided by them, to eat on the table, Some will say; “Against the U.S. Government and the Socialist Liberals amongst us? No! We will run and we will live. It is better to be Red than dead! I would rather live on my knees than die on my feet!” You perhaps laugh? Calculate the cost of gasoline, electricity, food and subtract that from your paycheck after 80% of your earnings are taken away. How are you going to afford anything? How will you be able to support your family? If you place your head in the sand on this one, in just a few years, when Obama and his Democratic Socialist ilk, like Nancy Pelosi and Harry Reid and the rest, start to raise withholding from your paycheck, just remember, if you are not apart of the SOLUTION you are apart of THE PROBLEM. You may be scared to even do anything more than lip service on this forum and then perhaps you will run to live and avoid trouble, pain and perhaps even death, as they the IRS SWAT has shot people as you know from the news. So, Aye, fight and you may die. Run, and you’ll live… at least a while. And dying in your beds, many years from now, in your apartments in the core of the cities surrounded by U.S. Government TV cameras, would you be willin’ to trade ALL the days, from this day to that, for one chance, just one chance, to come back here and tell our enemies that they may take our lives, but they’ll never take… OUR FREEDOM! This is what it has come to. Many of you just do not realize it yet. How many more have to loose their jobs, their ability to drive because of the cost, their ability to heat their homes during the winter because of the cost, their ability to light their homes at night because of the cost, or their ability to eat because of the cost caused by the U.S. Government’s mandate to FORCE ethanol percentages into our gasoline, and how many will have to lose their lives? That is until our U.S. Government, using the silver tongue of Barack Obama, gives us “The Final Ultimatum” What then? Are we going to appease? Are we going to retreat? Are we going to compromise until we have nothing left to compromise with? How much of our financial assets are we going to let Government take away from us through gasoline, heating, light, electricity, food prices and ADDITIONAL taxation for Social Security and Medicare? If we let them financially suffocate us and our children, to the point we have nothing left, how are we going to fight for FREEDOM (from Government) by FIGHTING FOR The Constitution of the United (but separate) States (with “States Rights” able to compete for us) of America? How are we going to fight them when we are financially strapped by the time Obama gives us “THE FINAL ULTIMATUM”. What then? At the same time, can’t we introduce voluntary features that would permit a citizen who can do better on his own to be excused upon presentation of evidence that he had made provisions for the non-earning years? Should we allow a widow with children to work, and not lose the benefits supposedly paid for by her deceased husband? Shouldn’t you and I be allowed to declare who our beneficiaries will be under these programs, which we cannot do? I think we are for telling our senior citizens that no one in this country should be denied medical care because of a lack of funds. But I think we are against forcing all citizens, regardless of need, into a compulsory government program, especially when we have such examples, as announced last week, when France admitted that their Medicare program was now bankrupt. They’ve come to the end of the road. No government ever voluntarily reduces itself in size. Government programs, once launched, never disappear. Actually, a government bureau is the nearest thing to eternal life we’ll ever see on this Earth. Federal employees number in the multitude of millions, and federal, state, and local, one out of six of the nation’s work force is employed by the government. These proliferating bureaus with their thousands of regulations have cost us many of our constitutional safeguards. How many of us realize that today federal agents can invade a man’s property without a warrant? They can impose a fine without a formal hearing, let alone a trial by jury, and they can seize and sell his property in auction to enforce the payment of that fine. How many of you realize that in many IRS court cases that I have studied the judge has refused to let the accused use THE LAW in his defense, when he said; “You will not bring the law into my courtroom!” In Chico County, Arkansas, James Wier overplanted his rice allotment. The government obtained a $17,000 judgment, and a U.S. marshal sold his 950-acre farm at auction. The government said it was necessary as a warning to others to make the system work. If we could elect the right person to become President, I don’t know if even he could stop the advance of socialism in the United States because we have come that far. Certainly neither Obama nor McCain will do anything to stop the march toward Socialism and the end of our FREEDOM (from Government). Now it doesn’t require expropriation or confiscation of private property or business to impose socialism on a people. What does it mean whether you hold the deed or the title to your business or property if the government holds the power of life and death over that business or property? Such machinery already exists. The government can find some charge to bring against any concern it chooses to prosecute. Every businessman has his own tale of harassment. Somewhere a perversion has taken place. Our natural, inalienable rights are now considered to be a dispensation of government, and freedom has never been so fragile, so close to slipping from our grasp as it is at this moment. Our Democratic opponents seem unwilling to debate these issues. They want to make you and I believe that this is a contest between two men…that we are to choose just between two personalities. But neither of these two men are willing to stop our forced march to the inner core city apartment complexes of Socialism at the hands of the despots in Congress and their masters the owners of THE FEDERAL RESERVE that borrows our INCOME TAX money to the U.S. Government, other foreign governments and domestic and foreign business entities, that they spend, at profitable interest that we again pay. The privately held central bank that collects every nickel of our Income Taxes and uses it for their own profit, investment and power to eventually and ultimately control the world through their private club of the Super Powerful, who owns all major main stream media outlets and there by dictates our main news sources so we are fed with the information they want us to have, called the Trilateral Commission www.trilateral.org. Not too long ago two friends of mine were talking to a Cuban refugee, a businessman who had escaped from Castro, and in the midst of his story one of my friends turned to the other and said, “We don’t know how lucky we are.” And the Cuban stopped and said, “How lucky you are! I had someplace to escape to.” In that sentence he told us the entire story. If we lose freedom here, there is no place to escape to. This is the last stand on Earth. And this idea that government is beholden to the people, that it has no other source of power except to sovereign people, is still the newest and most unique idea in all the long history of man’s relation to man. This is the issue of this War. Whether we believe in our capacity for self-government or whether we abandon the American revolution and confess that a little intellectual elite in a far-distant capital can plan our lives for us better than we can plan them ourselves. You and I are told increasingly that we have to choose between a left or right, but I would like to suggest that there is no such thing as a left or right. There is only an up or down–up to a man’s age-old dream, the ultimate in individual freedom consistent with law and order–or down to the ant heap totalitarianism, and regardless of their sincerity, their humanitarian motives, those who would trade our freedom for “financial security” have embarked on this downward course. In this vote-harvesting time, they use terms like the “Great Society,” or as we were told a few days ago by Hillary, we must accept a “greater government activity in the affairs of the people.” But they have been a little more explicit in the past and among themselves–and all of the things that I now will quote have appeared in print. These are not Republican accusations. For example, they have voices that say “our problems will end through acceptance of a not undemocratic socialism.” Another voice says that the profit motive has become outmoded, it must be replaced by the incentives of the welfare state; or our traditional system of individual freedom is incapable of solving the complex problems of the 21st century. Several Democratic Senators have said that the Constitution is outmoded. They referred to the president and Congress as our moral teachers and our leaders, and they said they are hobbled in their task by the restrictions in power imposed on them by this antiquated document. They must be freed so that they can do for us what they know is best. And Senators like Obama, another articulate spokesman, defines liberalism as “meeting the material needs of the masses through the full power of centralized government.” Well, I for one resent it when a representative of the people refers to you and me–the free man and woman of this country–as “the masses.” This is a term we haven’t applied to ourselves in America. But beyond that, “the full power of centralized government”–this was the very thing the Founding Fathers sought to minimize. They knew that governments don’t control things. A government can’t control the economy without controlling people. And they know when a government sets out to do that, it must use force and coercion to achieve its purpose. They also knew, those Founding Fathers, that outside of its legitimate functions, government does nothing as well or as economically as the private sector of the economy. Meanwhile, back in the countryside, under the super secret NAFTA Highway project, the assault on freedom carries on. Private property rights are so diluted that public interest is almost anything that a few government planners, including from countries outside of America, decide it should be. In a program that takes for the needy and gives to the greedy, we see such spectacles in cities and suburbs across America, a million-and-a-half-dollar private business completed only three years ago must be destroyed to make way for what government officials call a “more compatible use of the land.” We have so many people who can’t see a fat man standing beside a thin one without coming to the conclusion that the fat man got that way by taking advantage of the thin one. So they are going to solve all the problems of human misery through government and government planning. Well, now, if government planning and welfare had the answer and they’ve had almost 30 years of it, shouldn’t we expect government to almost read the score to us once in a while? Shouldn’t they be telling us about the decline each year in the number of people needing help? The reduction in the need for public housing? Yet anytime you and I question the schemes of the do-gooders, we are denounced as being against their humanitarian goals. They say we are always “against” things, never “for” anything. Well, the trouble with our liberal friends is not that they are ignorant, but that they know so much that isn’t so. We are for a provision that destitution should not follow unemployment by reason of old age, and to that end we have accepted Social Security as a step toward meeting the problem. But we are against those entrusted with this program when they practice deception regarding its fiscal shortcomings, when they charge that any criticism of the program means that we want to end payments to those who depend on them for livelihood. They have called it insurance to us in a hundred million pieces of literature. But then they appeared before the Supreme Court and they testified that it was a welfare program. They only use the term “insurance” to sell it to the people. And they said Social Security dues are a tax for the general use of the government, and the government has used that tax. There is no fund actuaries appeared before a congressional committee and admitted that Social Security as of this moment is TRILLIONS OF DOLLARS in the hole. But he said there should be no cause for worry because as long as they have the power to tax, they could always take away from the people whatever they needed to bail them out of trouble! And they are GOING TO DO just that. |

Those who would trade our freedom for the soup kitchen of the welfare state, who would appease the Socialists and Liberals, have told us that they have a utopian solution of peace without victory. They call their policy “accommodation.” And they say if we only avoid any direct confrontation with the enemy, the tyrants of U.S. Government, Congress, Socialist and Liberal Loyalists, ready to force us into Socialism, they will forget their evil ways and learn to love us. All who oppose them are indicted as warmongers. They say we offer simple answers to complex problems. Well, perhaps there is a simple answer–not an easy answer–but simple.
If you and I have the courage to tell our elected officials that we want our national policy based upon what we know in our hearts is morally right. We cannot buy our security, our freedom from the threat of a combination Civil / Re-Revolutionary War in support of The U.S. Constitution to protect our freedom and our prosperity by committing an immorality so great as saying to a three hundred million Americans now in slavery under the taxation of the privately held corporation called THE FEDERAL RESERVE, “Give up your dreams of freedom because to save our own skin, we are willing to make a deal with your slave masters.” Alexander Hamilton said, “A nation which can prefer disgrace to danger is prepared for a master, and deserves one.” Let’s set the record straight. There is no argument over the choice between peace and war, but there is only one guaranteed way you can have peace–and you can have it in the next second–surrender.
Admittedly there is a risk in any course we follow other than this, but every lesson in history tells us that the greater risk lies in appeasement, and this is the specter our well-meaning liberal friends refuse to face–that their policy of accommodation is appeasement, and it gives no choice between peace and war, only between fight and surrender. If we continue to accommodate, continue to back and retreat, eventually we have to face the final demand–the ultimatum. And what then? When Barack Obama has told his people he knows what our answer will be? He has told them that we are retreating under the pressure of high energy costs, and someday when the time comes to deliver the ultimatum, our surrender will be voluntary because by that time we will have weakened from within spiritually, morally, and economically. He believes this because from our side he has heard voices pleading for “peace at any price” or “better Red than dead,” or as one commentator put it, he would rather “live on his knees than die on his feet.”
And therein lies the road to war, because those voices don’t speak for the rest of us. You and I know and do not believe that life is so dear and peace so sweet as to be purchased at the price of chains and slavery. If nothing in life is worth dying for, when did this begin–just in the face of this enemy? Or should Moses have told the children of Israel to live in slavery under the pharaohs? Should Christ have refused the cross? Should the patriots at Concord Bridge have thrown down their guns and refused to fire the shot heard ’round the world? The martyrs of history were not fools, and our honored dead who gave their lives to stop the advance of the Nazis didn’t die in vain. Where, then, is the road to peace? Well, it’s a simple answer after all.
You and I have the courage to say to our enemies, “There is a price we will not pay.” There is a point beyond which they must not advance. This is the meaning in the phrase “peace through strength. AND UNITED WE STAND!” Winston Churchill said that “the destiny of man is not measured by material computation. When great forces are on the move in the world, we learn we are spirits–not animals.” And he said, “There is something going on in time and space, and beyond time and space, which, whether we like it or not, spells duty.”
You and I have a rendezvous with destiny. We will preserve for our children this, the last best hope of man on Earth, or we will sentence them to take the last step into a thousand years of darkness.

If the government will let you keep your additional earnings. What about when they tax your earnings 80%+ and ensure that nobody get to keep anymore net earnings than anyone else.
The government is going to have to tax all working class citzens at least 80% just to pay for Social Security and Medicare ALONE, not including ANY other Government program with in the next 3 – 5 years. What about that?
