Karl askes, How Long are WE Going to Take This, People of Wisconsin?  Sure the Democrats caused this because they are in power right now.  But a lot of Republicans in the past are just smoke and mirrors too.  They say one thing and do the other.  The Republicans talk of shrinking the size and scope of the Wisconsin Government, but have they actually done it when they were in power?  Republicans, as a whole, sure there are some GREAT ONES, such as John Nygren and Leah Vukmir and a few others, but there are many more who are all talk and no do.</span></span></strong></p>

<p> I believe this <a href="http://www.givemeliberty.org/">NEW Continental Congress</a> is the best way to retrieve and restore our individual God given Constitutional rights, powers and authorities, which have been usurped by both parties and all three branches of the U.S. Government, to the people.  I believe that through this <strong><a href="http://www.givemeliberty.org/">NEW Continental Congress</a></strong> we will be able to ENFORCE, to the full force and effect of the law, the ‘enumerated’ powers clauses of <a href="http://www.usconstitution.net/const.html#A1Sec8">Article 1 Section 8</a>, as further supported by <a href="http://www.usconstitution.net/const.html#Am9">the 9<sup>th</sup> and 10<sup>th</sup> Amendments</a> in The Bill of Rights of the Constitution of The United States of America.  I further believe that enforcing these laws on the U.S. Government, where we the people only authorized them to have the ‘privilege’ to handle these seventeen enumerated items as listed in The Constitution, the obvious result would be a full restoration of our freedom, liberty, unalienable rights and individual prosperity for the vast majority of our fellow countrymen; through hard work and being able to keep their earnings that otherwise is unconstitutionally stolen by the tyrannical, corrupt despots in the U.S. Government through the usurpation of authorities and responsibilities we never gave them or authorized in any way, shape manner or form which has resulted in this:  <a href="http://www.usdebtclock.org/"><strong>us</strong> National <strong>Debt Clock</strong> : Real Time</a>  I would further submit that it is likely that the U.S. Government is going to make us and our posterity pay for this ungodly insanity, UNLESS we enforce the RULE OF LAW as we wrote, established and ordained on the U.S. Government in The Constitution of the United States of America.  The <strong>“How are we going to do that?”</strong> question will be answered at the NEW Continental Congress by the discussions and plans laid by the 3 “citizen” delegates selected from each State.</p>
<p> If you have been reading <a href="http://captkarl.blogivists.com/">The Liberty Tree Lantern</a> then you have been well posted on these developments of this <a href="http://www.givemeliberty.org/">NEW Continental Congress</a> which is to convene in St. Charles, IL at the <a href="http://www.pheasantrun.com/conferences/index.htm">Pheasent Run Resort and Conference Center</a> on Sunday November 8<sup>th</sup> and will be attended by 3 citizen delegates from every State in the Union.  My understanding is that some of the proceedings will be recorded by camera and reported/ televised by some news organizations to keep the American public informed as to the discussions and plans formulated by the NEW Continental Congress.</p>
<p> I would note that <strong>today is the last day for nomination of all representative “citizen” delegates, three from each State. </strong>So if you know anyone who you believe would be an exceptional “citizen” candidate (not tied to either of the two major political parties)  to represent the “<strong>people</strong>” of Wisconsin, today is your last chance to nominate them and get them on the ballot.  <strong><em>This Continental Congress 2009 has the potential to be a very big historical event in the heritage of America’s contemporary history.</em></strong></p>

<p>These documents will also be posted on the Wisconsin webpage at <a href="http://givemeliberty.org/user/congress/Region.aspx?state=wi">http://givemeliberty.org/user/congress/Region.aspx?state=wi</a> sometime next week.</p>
<p>By using the mail-in option, you may start voting today.  You may also want to wait until you get a chance to meet the candidates at the Candidate Forum on October 1<sup>st</sup> at the Olympia Resort and Spa.  Each candidate is also profiled on the Wisconsin webpage.</p>
<p>The instructions indicate that the ballot and the registration form should be put in separate envelopes and then mailed together in a larger envelope.  The purpose of this separation is to ensure a secret ballot.  However, even if your ballot and registration form are mailed together in the same envelope, I can assure you that your ballot and registration will be separated when the envelope is opened.  The secret ballot will still be maintained.  Your ballot will still be counted even if it is enclosed in the same envelope as the registration form.</p>
<p>Now is the time to peacefully restore our Constitutional Republic.  The Continental Congress is the best option for this to happen.  We the People, acting as sovereign individuals, can make this Continental Congress meaningful and effective by voting in large numbers.  Let’s make it happen.  Our liberty depends on it!</p>

<p class="MsoPlainText" style="margin: 0in 0in 0pt"><span style="color: #1f497d">It is important that all of our freedom / liberty groups converge to form a voice that can no longer be ignored.<span>  </span>I believe that we are facing times that try men’s souls.<span>  </span>I believe that our unsustainable economy, based on little more than monopoly money, will have incredible growth over the next few months.<span>  </span>And, that is what scares me.<span>  </span>That is exactly what happened in 1929 just before the bottom fell out on Black Friday.<span>  </span>I believe that our economy will become so good that windows in excess of 8 stories will become all the rage on the Black Friday yet to come, that will make the last one look like a cake walk.<span>  </span>I believe that the entire world will revalue the dollar to its true value of 2 – 3 cents in panic selling of all dollar based assets.<span>  </span>I believe that everything will stop, after an explosive growth I call The Supernova Effect and then implode almost overnight.</span></p>

<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-family: Consolas;color: #1f497d">We need to be sure that people are fully grounded in the 28 principles of freedom as written in the book “The 5000 Year Leap”, hopefully before the collapse caused by an overnight global hyper-inflation panic; all of which would have been avoided if our Government would have obeyed the law that we wrote, established and ordained in The Constitution to prevent the tyranny, usurpation and despotism that has placed us in the tenuous economic and political straits, via incrementalism of Constitutional contempt spread over nearly ten decades now, of which we find ourselves in.<span>  </span>The contamination of usurpation now buried deep in the root system of Washington and also now instilled into many American minds of today, as taught in public schools for example, is of such a heinous nature and odious level that a mere election, no matter how sweeping will never resolve the problem alone.<span>  </span>It is ingrained deep within most American minds that our Government “has to” do all the usurped powers that are far beyond the scope allowed by law in the Constitution.<span>  </span>These usurpations have grown to such a level that if you talk with most attorneys on the subject they will admit as much and then go on to say that The Constitution is a “living breathing” document that was “{never intended to be a bedrock of our society and governance because the founding father knew that technology and human needs would change”; they will say.<span>  </span>Poppycock! <span> </span></span><span style="font-family: Consolas;color: navy;font-size: 10pt">How strangely will the Tools of a Tyrant pervert the plain Meaning of Words!</span></p>

<p class="MsoPlainText" style="margin: 0in 0in 0pt"><span style="color: #1f497d">The matter is so grave that not even a synapse of the human mind sparks in the comprehension that our Federal Government is bound by law to handle only </span><strong><span style="color: #1f497d;font-size: 14pt">SEVENTEEN</span></strong><span style="color: #1f497d"> <strong>enumerated</strong> items and is expressly forbidden by the 9<sup>th</sup> and 10<sup>th</sup> Amendments to do </span><strong><span style="color: #1f497d;font-size: 12pt">ANYTHING else</span></strong><span style="color: #1f497d">.<span>  </span>Further, the average mind cannot comprehend the immenseness of economic and societal human benefit that would result from such ENFORCEMENT of law.<span>  </span>Can you imagine the multi-fold economic benefit of Trillions of dollars “left” in our productive hands and in our economy in lieu of the consumptive parasitic convolutions of the Federal Government.<span>  </span>The advancement of the human condition and society as a whole, especially when combined with our current level of technology, as a result of compelling our Federal Government to obeying the law, word for word in spirit and intent as it WAS meant before the economic draining spin cycle of despotic politicians, is utterly unfathomable.<span>  </span>But the resulting obvious demolishment of 4/5ths of our Federal Government, as WILL happen no matter what </span><span style="color: #1f497d;font-size: 20pt">if</span><span style="color: #1f497d"> we are to restore our freedom, is also quite hard to have a handle on as well.<span>  </span>This is another reason why </span><strong><span style="color: #1f497d;font-size: 14pt">an ordinary election, NO MATTER HOW SWEEPING, will not resolve the problem.</span></strong><span style="color: #1f497d"><span>  </span>The answer to our national dilemma is not Government, it is us.<span>  </span>Government, in its current unconstitutional form, size and mindset is the problem that must be overcome and corrected down to its very roots to restore <strong><em>and SUSTAIN </em></strong>our individual liberty and prosperity. And all of this that must happen and be executed,,,<span>  </span>with the dark ominous clouds of Black Friday building / looming just over the horizon, which will be almost completely hidden from view by the Supernova expanding before our very eyes as the result of trillions on top of trillions of dollars in monopoly money being pumped into our economy, by the Fed, with impunity. This is shear madness, and with this madness is sure to come Obama&#8217;s “<strong>final ultimatum</strong>” to forgo our Constitution in favor of a one world currency, shortly followed by a one world Government, for the sake of stabilizing and maintaining the Matrix like world that exists around us because we have been brainwashed to actually believe that pieces of paper and ink are worth 100 cents, when in reality they are actually worth more like 2 – 3 cents, which will be realized in a period of hyper-inflation yet to come.</span></p>

<p>If Democratic lawmakers thought all the furor over President Obama&#8217;s health care plan expressed this month at town hall meetings was dying down, they might be in for a surprise Saturday.</p>
<p>That&#8217;s when citizens are planning anti-&#8221;Obamacare&#8221; rallies across the country Saturday in all 435 congressional districts.</p>
<p>And their message is clear: We will not stand for socialized, government-controlled health care.</p>
<p>The same groups who made the &#8220;tax tea parties&#8221; possible in April are behind this weekend&#8217;s movement. American Liberty Alliance, FreedomWorks and Americans for Prosperity are working with The Sam Adams Alliance, among others, to stage the rallies.</p>

<p>They come as town hall clashes between Democratic lawmakers and protesters of Obama&#8217;s health care plan have captured national attention. Some Democrats have dismissed those protesters as &#8220;mobs&#8221; organized by special interests. But many protesters have said they attended the town halls out of genuine concern.</p>
<p>Now they can express their concerns at Saturday&#8217;s rallies.</p>
<p>&#8220;Obviously the idea behind this was to have a unified day for those concerned about government-controlled health care to talk outside their representatives&#8217; offices,&#8221; said Paul Miller, spokesman for The Sam Adams Alliance, a Chicago-based political organization which is one of several groups promoting the event through new media.</p>
<p>Miller said this is a personal issue for many opponents, including himself, a 22-year cancer survivor. Miller, who was diagnosed with a rare cancer at the age of 14 and had his right arm amputated to save his life, says he would not have received the same specialized and speedy medical care if the government was in control.</p>
<p>&#8220;There isn&#8217;t this great conspiracy to say there shouldn&#8217;t be health care reform,&#8221; Miller told FOXNews.com. &#8220;People just want to make their own decisions and keep their insurance if they like. When government&#8217;s get involved, they never do anything right.&#8221;</p>
<p>Eric Odom, executive director for American Liberty Alliance, the lead group behind the tea parties and the new rallies told FOXNews.com that the rallies differ from the tea parties in that they are being organized from the bottom up.</p>
<p>&#8220;We didn&#8217;t want to try and do what we did on April 15 because the logistics was a nightmare,&#8221; he said, explaining that local organizers now have more control over the rallies and have only received basic information from the top.</p>
<p>&#8220;People at the local level have taken it and created their own animal with it,&#8221; he said. &#8220;This is more bottom heavy.&#8221;</p>
<p>Odom shrugged at the fact that most of the lawmakers won&#8217;t be present at their offices on a Saturday because he said the ultimate goal is to get more people politically engaged.</p>
<p>&#8220;This Saturday is symbolic,&#8221; he said, adding that his group will e-mail information to rally-goers on how to air their concerns to their representatives. &#8220;Most of these people have never done anything political in their lives.&#8221;</p>
<p>Phil Kerpen, director of policy for Americans for Prosperity, cautioned that it&#8217;s &#8220;impossible to predict&#8221; the turnout at these rallies &#8220;because it&#8217;s very decentralized.&#8221;</p>
<p>&#8220;It could be another big success,&#8221; he said, or the crowds could be scaled back. Kerpen said the packed town halls this month don&#8217;t provide much indication either.</p>
<p>&#8220;I think there&#8217;s no better place to make your voice heard and make an impact when you get face to face with your congressman,&#8221; he said. &#8220;The impetus is greater to show up there than here.&#8221;</p>
<p>Jacki Schechner, spokeswoman for Health Care for America Now (HCAN), a coalition of groups supporting Obama&#8217;s health care plan, said the rallies are a waste of time.</p>
<p>&#8220;There is no government-controlled health care on the table,&#8221; she said. &#8220;They&#8217;re protesting something that doesn&#8217;t exist.</p>
<p>&#8220;There&#8217;s a lot of people out there feeding lies and misinformation and trying to get people hyped up about something that doesn&#8217;t exist. They&#8217;re wasting their energy.&#8221;</p>
<p>Odom found irony in the objections raised by proponents of health care reform.</p>
<p>&#8220;It&#8217;s interesting that the world&#8217;s most professional organizers are upset that we&#8217;re organizing communities,&#8221; he said.</p>
<p>But Odom said he hasn&#8217;t gotten a lot of pushback.</p>
<p>&#8220;Surprisingly, I don&#8217;t think they take this very seriously,&#8221; he said. But he said what separates his organizers from many of Obama&#8217;s supporters, including Health Care for America Now (HCAN), is the passion.</p>
<p>&#8220;For them it&#8217;s business as usual. It&#8217;s what they&#8217;re paid to do,&#8221; he said.</p>
<p>Schechner said the differences between the two sides goes beyond money.</p>
<p>&#8220;We didn&#8217;t pop up over night,&#8221; she said, noting that the group&#8217;s campaign began last summer. &#8220;We don&#8217;t scream. We&#8217;re not angry.&#8221;</p>
<p>She rejected the notion that community organizers who are paid lack passion. &#8220;There are different kinds of passion,&#8221; she said.</p>
<p>Schechner added, &#8220;I don&#8217;t discount their passion. I don&#8217;t ever want to undermine their passion. But I really wish they would take a moment to really understand what this legislation is about, because a lot of people would be helped by it.&#8221;</p>
<p>But Kerpen said it&#8217;s clear that Obama&#8217;s plan would lead to a government takeover.</p>
<p>&#8220;Read the legislation that&#8217;s been proposed,&#8221; he said, adding that the House bill has been &#8220;designed as an achievable way to reach a single-payer system,&#8221; in which the government acts as the sole middle man with greater leverage to negotiate prices. &#8220;A lot of people are playing games, as we would expect them to.&#8221;</p>

<p>Among numerous other virtually identical procedures, all county clerks and registers of deeds are required to issue applications and record &#8220;declarations&#8221; for domestic partnerships, just as they issue applications and record licenses for marriages. The &#8220;declarations&#8221; are then sent to the state Registrar of Vital Statistics for recording, the same as marriage documents. A reasonable person looking at the parallel provisions of Ch. 765 and Ch. 770 would conclude that <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qSoFPU2rsTquqM-fXzxkGROJmdN3dg0D2X6mITIS_8xobS43MBdirmiwWIk2gl7G3qEmm3ov7Mae04aLbnBrUx4ZZTE5pipcs9Qs1HeSBAVrlWet3MhIhgmBLAZOfibl-7aaeDzo9Wi7ZyPr-DQ5LmJSem1fZ9aK7EET0q-yPIdZ4qG2w5Grub" target="_blank">Ch. 770 </a>is, and was intended to be, &#8220;marriage&#8221; for same-sex couples, and that its primary function is to confer upon same-sex relationships the same official state approval and &#8220;ceremonial solemnity&#8221; as is conferred upon marriage.</p>

The Democratic state chairman is <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qKNlupGPT86VxwzzHiVno2lDMF32k2ZHN9YLhlGFhBBXxZ71mWLesdv6WraO0EsewgjQbmoSPeSu4aAUpj_3A7FAwZRSdCbBNcoWD7Udp-qo-vtg3qKcO3" target="_blank">Mike Tate</a>, the former director of the advocacy group <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4oq_XpoSXlQSFDHAL9cYN3kfhmIAKiT_PnggzVBP_-_L63Je3-W79nT0_Ev0O1guY37R6eqUkckky2RJK_lGc7YGuBNyQQ1xXVgjn-FG7A8KQ==" target="_blank">Fair Wisconsin</a>, which led the anti-Amendment campaign in 2006. Not surprisingly, the 2009 legislature included findings in Ch. 770 that the domestic partner status is not &#8220;substantially similar to marriage,&#8221; so the state supreme court will eventually decide who is correct &#8211; the supporters of Ch. 770, or the supporters of the Amendment.</p>

<p>Already before the court is <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qjTUKOkVGCyIiNOvKhwRj7tqKhrRa9oQ4LmPYh0xgtARRTUAflqafiIR5FGwPvbA_NTiE_6huDz--bfZm0TpEohsdw_lqOK-s43zqQcyHkIveSQ0ayMTWU8IE6udVC1isv6JJ9gLaT3lc-v4X_TXpYGiiIIemEorMLuJwgxMXtPA==" target="_blank">McConkey v. Van Hollen</a>, a case in which UW Professor William McConkey claims that the Amendment itself violates the Wisconsin Constitution. McConkey argues that the two sentences of the Amendment deal with &#8220;separate subjects&#8221; in violation of the &#8220;single subject&#8221; rule provided in Art. XII, § 1, which requires that individual amendments be first approved by a majority of the Assembly and Senate in successive legislative sessions, then presented &#8220;separately&#8221; to the people for final vote. The Amendment is defended by Republican <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4rOgwiF1kN4Lm6mkEj76-vEo2W8RRcoKJVtc4qsswjaasqwwQk8y1YJGh-rdKNs3nNueuFM_adt4XudR7b_RqaowokfYknV-lRd5mCNH6xwK6GwHwWodc3c" target="_blank">Attorney General J.B. Van Hollen</a>, and Professor McConkey is represented by Democratic Gov. Doyle&#8217;s own personal attorney, <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4p04gV5YpuskzO4jLo5lrMP1EtYKK756ZFc36V_z-C5QC0ZqF3o6rfQjsvBlgkQSNUDsXM377Rg9S7XbIh6q3IvppZ_j9msG-YH5cSWcshTXqc9ZlhOJM29BBH1WO0aQ2WbBBCbrblPBIug49JTuiex" target="_blank">Lester Pines</a>.</p>
<p>But far more is at stake in these cases than constitutional curiosities and political &#8220;inside baseball.&#8221; As Wisconsin courts and the Legislature have long recognized, impairing marriage as an institution inflicts damage far beyond individual husbands and wives immediately affected. The Legislature has summed up that understanding in § 765.001 of the Statutes:</p>
<p>Marriage is the institution that is the foundation of the family and of society. Its stability is basic to morality and civilization, and of vital interest to society and the state. The consequences of the marriage contract are more significant to society than those of other contracts, and the public interest must be taken into account always.  . . . .  <em>The impairment or dissolution of the marriage relation generally results in injury to the public wholly apart from the effect upon the parties immediately concerned.</em></p>
<p>Like the courts and Legislature, Petitioners also realize that any &#8220;impairment of the marriage relation&#8221; has a far-reaching effect. They understand that there has developed in recent history a fundamental conflict between competing conceptions of marriage, on which hangs the future of society and culture.</p>
<p>Petitioners recognize that marriage is &#8220;conjugal&#8221; in nature &#8211; that it has existed time-out-of-mind, rooted in nature itself and inextricably connected with the prospect of children and the inherent responsibility and orientation towards the future they demand. That meaning has been understood and accepted throughout history because marriage has always been about far more than the gratification and &#8220;rights&#8221; of the man and woman involved in it.</p>
<p>In most cases actually, and in all cases symbolically, marriage is about children, and about the understanding that children having both their father and their mother is the norm. By officially establishing and encouraging marriage, the state recognizes that that norm is best, both for children and for society. The conjugal conception of marriage is therefore reflected in the Amendment and in state statutes prior to <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qSoFPU2rsTquqM-fXzxkGROJmdN3dg0D2X6mITIS_8xobS43MBdirmiwWIk2gl7G3qEmm3ov7Mae04aLbnBrUx4ZZTE5pipcs9Qs1HeSBAVrlWet3MhIhgmBLAZOfibl-7aaeDzo9Wi7ZyPr-DQ5LmJSem1fZ9aK7EET0q-yPIdZ4qG2w5Grub" target="_blank">Ch. 770</a>, and it is the constitutional establishment of that conception that Petitioners seek to preserve in <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4oY5P9jsfhn3CiG5Sx9rxFUD0CFqSkMKZR7eyYKEuIMBsItpkn63pwfYgE-A6PgygB7AZUt9hapzBOk2WKIR3HzJwA7cEkHJINsAwWPxnd3k3yUHORYAIbulpcMLnCVFqO2jO1AG15yn_mSDAsQg6ziWF8pv6l15SReEO5Red_UxQ==" target="_blank">Appling v Doyle</a>.</p>
<p>Opposed to the &#8220;conjugal&#8221; meaning of marriage is the &#8220;relationship&#8221; model, codified in Ch. 770 and supported by Gov. Doyle, the Legislature&#8217;s Democratic majority, Fair Wisconsin, Lambda Legal, and other &#8220;gay rights&#8221; proponents. The &#8220;relationship&#8221; model asserts that marriage is not unique, that it has same-sex or other &#8220;functional equivalents,&#8221; and that both marriage and same-sex relationships are essentially social or legal constructs that exist principally to satisfy the personal needs and desires of the individuals who choose to form them. Proponents of the relationship model therefore argue that denying same-sex couples the same legal status as spouses is not a recognition and preservation of the unique nature of marriage and the spousal relationship, but is rather a denial of &#8220;equal rights.&#8221;</p>
<p align="center">But comparing marriage and same-sex relationships in terms of &#8220;rights&#8221; presumes that marriage is not unique; that it is, in fact, possible for same-sex relationships to be the functional equivalent of marriage; and that, as a matter of law, same-sex couples are &#8220;similarly situated&#8221; to spouses under the Wisconsin Constitution&#8217;s equal protection provisions. Thus, even talking about marriage in &#8220;the language of rights&#8221; is a strategy to fundamentally change the &#8220;conjugal&#8221; meaning of marriage in the public mind.</p>
<p>In defending <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qSoFPU2rsTquqM-fXzxkGROJmdN3dg0D2X6mITIS_8xobS43MBdirmiwWIk2gl7G3qEmm3ov7Mae04aLbnBrUx4ZZTE5pipcs9Qs1HeSBAVrlWet3MhIhgmBLAZOfibl-7aaeDzo9Wi7ZyPr-DQ5LmJSem1fZ9aK7EET0q-yPIdZ4qG2w5Grub" target="_blank">Ch. 770,</a> Gov. Doyle and other proponents have confirmed that changing the public meaning and understanding of marriage is exactly its intent and effect. They argue that it does not create a legal status substantially similar to marriage, but that it is, instead, only a partial step in securing &#8220;equal rights and protections&#8221; for <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4oNIIByQqPFEn56dsdaq6o6OAKMusYdjgxrOKtCr8OXPV7zPnc58B94EVxtSnc8Gl_NXM75PFR8E9Bc8c0TGbIdpslzTsHHMwXeT1B6sIYgrZueX9VtQ0ndz9EjR6suhMoyZTdbERBi4euqmHuXPkD1RNxyNj1yTXpfuRrrGRa9XHpJSPkq0l6Ax2xAJM55LvE=" target="_blank">same-sex couples</a>.</p>
<p>Clearly, they are correct. Chapter 770&#8217;s official endorsement of &#8220;look-alike&#8221; same-sex relationships sends a powerful message to the public that marriage is merely the legal equivalent of relationships which are not primarily about the benefit of children and responsibility for the future, but which are instead about the rights and gratification of adults in the present. In establishing a same-sex legal status that mimics the official &#8220;ceremonial&#8221; and procedural appearance of marriage, Ch. 770 intentionally dilutes the uniqueness and significance of marriage in the public understanding and weakens the father-mother-child norm, for to the extent that &#8220;marriage&#8221; and &#8220;family&#8221; can mean <em>anything</em>, they mean <em>nothing</em>.</p>
<p>In <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qZdFHcH7_NFo_ScAQipQTUcgztUCC7h35r3dGjiu3XdyHkEBBOdvwy_vfr1-N3LgKIi4LKWwDFm6ty_bcYAKm6t4IC5u3hUn-goVZJeOBFHziM0VtsSX5Dyo99HaVtUPhoRa3wuM6-RdS4aI2imXHiB4qI_gLkBVoXAQRExZbvsI6cp5q1Rs7K" target="_blank">Ch. 40</a>, which mandates that government and large employers provide <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4pO3467vI2OZhnlcSGd-rOjJ9pU6KNYmeNV8ddQIb51Sg5QxSx6UIzZd4jJg2STQttR7RC5hnjXp-S066qAMoEdjTn0Uokm79hejUslc0jQj4wFgFSgVMS5qlKB1TC7FyG4pO7e8nNeTQ==" target="_blank">&#8220;domestic partner&#8221; benefits</a> to employees. Gov. Doyle and the Legislature went even further &#8211; they didn&#8217;t just <em>dilute</em> the meaning of &#8220;family,&#8221; they <em>bankrupted </em>it. Sec. 40.02(21d)(d) defines &#8220;domestic partnership&#8221; as being between two individuals who &#8220;consider themselves to be members of each other&#8217;s immediate family.&#8221; Ch. 40 doesn&#8217;t even require any intimate or emotional commitment. Thus, instead of the historic meaning of &#8220;family&#8221; as &#8220;father, mother, child,&#8221; Gov. Doyle and the Legislature have turned &#8220;family&#8221; into to &#8220;whatever two people think it is.&#8221;</p>

<p>Courts also recognize the conflict between the conjugal and relationship conceptions of marriage, as well as the consequences at stake for marriage, children, and culture. In 2001, the homosexual advocacy group <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4orgLK2FNIXT7JqqB__Etes5Bwv6JcJXFgmaKk65QqGyhV7v1nsCvBrUwZt-IeBCII2vYQ-D5IXCA8H3jHzAkJbxXdhJ6JiyTsLHBsQ856yZQ==" target="_blank">Lambda Legal </a>filed a brief in <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4p7E6gVTMTtMX3p2ohacgC1Y5Qgr5GFLE4y51bvqSw1Fx-hgmTJNPlDOFaRDu5lG9B9T0pFdmuA-Vyfg9uqnYGtjJ-fk0T8ma4xfl3sD1Qggl0njmdiQeRrBpnHrsMCdX6mfUKM6baKqLTsFiRcTG34m9oAfkRai5Fs26VpZrX9i__zGX_HTYFGhAHRws0ZbdWkdyC5N_EV7w==" target="_blank">Irizarry v. <p><a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4r2rmPMtOBYVMEBxc-gn4wd7geihQLMZdPlAGeezP0F3YGDTinagrp_rZ391Unrg7quXeGXEdsarkLDQQsJr5JfXgwyS6xi26Cb0-QEMFXnnK84QfdjdUsAcXK_Wucu_E8=" target="_blank">Judge Richard Posner</a> of the Seventh Circuit recognized that Lambda&#8217;s real objective in <em>Irizarry </em>was to &#8220;knock marriage off its perch . . . so that marriage will lose some of its luster.&#8221; He also recognized that the importance of the defendant Board&#8217;s &#8220;spouses only&#8221; policy was &#8220;essentially symbolic&#8221; rather than &#8220;practical.&#8221;</p>
<p align="center">Like Judge Posner, Petitioners recognize that the public symbolism and meaning of marriage are of far greater importance than any incidental benefits or obligations a legislature may attach to it, and that by creating and endorsing domestic partnerships which appear to be the ceremonial and functional equivalent of marriage, Ch. 770 does, in fact, &#8220;knock marriage off its perch,&#8221; costing &#8220;some of its luster.&#8221;</p>
<p><a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qSoFPU2rsTquqM-fXzxkGROJmdN3dg0D2X6mITIS_8xobS43MBdirmiwWIk2gl7G3qEmm3ov7Mae04aLbnBrUx4ZZTE5pipcs9Qs1HeSBAVrlWet3MhIhgmBLAZOfibl-7aaeDzo9Wi7ZyPr-DQ5LmJSem1fZ9aK7EET0q-yPIdZ4qG2w5Grub" target="_blank">Ch. 770</a>&#8217;s proponents recognize the extraordinary importance of that symbolism as well. Gov. Doyle and the Democratic majority could easily have extended statutory benefits and protections to same-sex couples without mimicking the procedures and appearance for creating and recognizing marriage. In fact, they did just that in <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4qZdFHcH7_NFo_ScAQipQTUcgztUCC7h35r3dGjiu3XdyHkEBBOdvwy_vfr1-N3LgKIi4LKWwDFm6ty_bcYAKm6t4IC5u3hUn-goVZJeOBFHziM0VtsSX5Dyo99HaVtUPhoRa3wuM6-RdS4aI2imXHiB4qI_gLkBVoXAQRExZbvsI6cp5q1Rs7K" target="_blank">Ch. 40</a>, creating a completely separate &#8220;reciprocal beneficiary&#8221; system without requiring Ch. 770&#8217;s &#8220;ceremonial&#8221; procedures for recognizing domestic partnerships. But because they recognized the symbolic significance and endorsement provided by official recognition of same-sex relationships, they enacted Ch. 770 anyway, setting the stage for the conflict between the Amendment and Ch. 770&#8217;s competing conceptions of marriage.</p>
<p>The consequences of that conflict and of <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4oY5P9jsfhn3CiG5Sx9rxFUD0CFqSkMKZR7eyYKEuIMBsItpkn63pwfYgE-A6PgygB7AZUt9hapzBOk2WKIR3HzJwA7cEkHJINsAwWPxnd3k3yUHORYAIbulpcMLnCVFqO2jO1AG15yn_mSDAsQg6ziWF8pv6l15SReEO5Red_UxQ==" target="_blank">Appling v. Doyle</a> will be profound. The conjugal conception of marriage having been self-evident for so long, it is difficult for most to conceive the radical &#8220;atomization&#8221; of a culture (to borrow Hannah Arendt&#8217;s term) in which the state advocates and normalizes the notion that the primary function of the most fundamental relationship of society is not procreation and perpetuation of the culture, but is rather the satisfaction of the idiosyncratic needs of those who comprise it &#8211; a notion which implies necessarily that marriage is merely a utilitarian construct, and that its legitimacy and  the underlying rationale for any particular relationship cease to exist when that relationship no longer serves the felt personal needs of the individuals involved.</p>
<p>Petitioners explain in paragraph 31 of their petition:</p>
<p>In contrast to the conjugal view is the &#8220;close relationship&#8221; model of marriage, <em>i.e.</em>, the notion that marriage is best seen primarily as a private relationship between two people, the primary purpose of which is to satisfy the adults who enter it. If the purpose of marriage is to facilitate close relationships, then it becomes about &#8211; and its norms are driven by &#8211; the idea of &#8220;pure relationship [<em>i.e.,</em>] . . . one that has been stripped of any goal beyond the intrinsic emotional, psychological, or sexual satisfaction which the relationship currently brings to the individuals involved.&#8221; Daniel Cere, <em><span style="text-decoration: underline">The Experts&#8217; Story of Courtship</span></em><span style="text-decoration: underline"> 6 (2000).</span></p>
<p>Like proponents of marriage amendments in other states, the Petitioners, legislators, and voters who proposed and approved the Wisconsin Defense of Marriage Amendment sought to prevent the Wisconsin courts and legislature from displacing age-old conceptions of marriage, children and society, and replacing them with conceptions whose consequences are already evident in Europe&#8217;s looming demise. The Wisconsin Supreme Court&#8217;s resolution of <a href="http://rs6.net/tn.jsp?et=1102481005844&amp;s=200&amp;e=001WAbGp4bYi4oY5P9jsfhn3CiG5Sx9rxFUD0CFqSkMKZR7eyYKEuIMBsItpkn63pwfYgE-A6PgygB7AZUt9hapzBOk2WKIR3HzJwA7cEkHJINsAwWPxnd3k3yUHORYAIbulpcMLnCVFqO2jO1AG15yn_mSDAsQg6ziWF8pv6l15SReEO5Red_UxQ==" target="_blank">Appling v. <p> The 10<sup>th</sup> Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.</p>

<h5>8/5/2009Thank you for listening to your constituents yesterday and Monday in Green Bay and Appleton. Listening. The operative word. Unlike media suggestions (your suggestions?), the crowds were not manufactured by shady “corporate interests,” but were caring, frustrated Americans, there to listen to you because they’re desperately fearful about the future of their beloved country – and the future we’re building here for our kids.I was moved by the passion – and I hope you were too. 300 people filled that auditorium a half hour before your meeting’s start time in both Green Bay and Appleton hearings. Perhaps next time your staff can find you a larger room, so that 300 or 400 constituents need not be locked out.As an aside sir, it’s interesting that I knew of your meeting schedule from friends and neighbors. In talking with the Steelworkers Union member (the emblem proudly emblazoned on his shirt) sitting behind me, I learned he received an email invitation from your office. You have my email sir, as I’ve contacted your office numerous times. You have my email sir, as I receive pleas for dollars from your campaign committee at the close of every campaign reporting period. Why didn’t I receive a notice of your “listening session” in Appleton?</p>
<p>Such passion Dr. Kagen. I’m not sure you got the message these caring and concerned constituents were sharing.</p>

<p>When a constituent said she heard the benefits of the medicine you and Congress are prescribing, now could you please share with us the side effects, you shrugged her off repeatedly, unable to “explain the whole thing because it will raise controversy.” Well, that surely is being honest, Rep. Kagen. Wow.</p>
<p>Rick Sense, writing for his “The Inside Scoop,” <a href="http://www.theinsidescoop.us/sense8409.htm" target="_blank">shares</a> further goings-on from yesterday’s gathering.</p>
<blockquote><p>Some of [Rep. Kagen’s] less than stellar moments included a claim that “the United States Senate is the real enemy” and that he believes it is “unconstitutional” for a pharmacy to be able to charge different people different prices for the same medication (ever buy a used car Rep. Kagen?). When asked if he would support healthcare legislation despite the majority of his constituents being opposed to it, he first replied, “Well, let me explain the legislative process to you,” later adding the cliché “these are complex issues” and ending his answer with, “I will vote for the best interest of our constituents.” At one point, obviously frustrated, Kagen yelled at a constituent, “How dare you!” during an exchange with a member of the audience on how to possibly help a different audience member facing the tough prospect of covering healthcare costs with her husband out of work.</p></blockquote>
<p>Yes sir, the majority of your constituents understand the need for reforms in our health care system. But no sir, the majority of your district is not in favor of huge new federal bureaucracies taking over health care in America.</p>
<p>You are well aware of those needed changes sir – and indeed have advocated for them.</p>
<ul>
<li>Incentivize self-reliance and individual responsibility. More of us must understand what our health care is costing us before we care about what health care is costing us.</li>
<li>Incentive individual responsibility via extensive price and quality transparency.</li>
<li>Incentivize wellness</li>
<li>Help us make good choices by standardizing basic health insurance policies</li>
<li>Support modified community rating and yes, require that insurance be available for those with pre-existing conditions. </li>
</ul>
<p>Hold your ground sir. You are not beholding to Speaker Pelosi or President Obama or any of your congressional colleagues. You sir, are beholding to us. The majority of your district does not want government running their health care. The majority of your district believes HR 3200 or anything like it must be scrapped and substituted with much more basic changes that will control costs in the system and build on individual – not government – responsibilities.</p>

		<description><![CDATA[Isn't it amazing the fools that the U.S. Government takes us for?  Basically, as you can see for yourself, the U.S. Government is stating, in so many words, that either we are as stupid as the day is long or the only other possibility is that we have been gathered and bused out to the listening sessions to make it "lo0k like" we care and that we are upset at what they are doing to us.  The U.S. Government is trying to make it look like everything we, here in N.E. Wisconsin are saying is nothing more than a ginned up "sham".

			<content:encoded><![CDATA[<p>Democrats, the Obama Administration and some media outlets have &#8220;publically&#8221; called northeastern Wisconsin citizens protesting the healthcare bill at Congressman Steve Kagen (D-WI) listening sessions in Green Bay and Appleton, &#8220;manufactured&#8221;.  In the following video you can clearly see that the U.S. Government and U.S. Congressmen are completely dismissing the citizen&#8217;s in N.E. Wisconsin as some sort of &#8220;fabrication&#8221; ginned up by special interest groups.</p>
